Consumer Litigation and Product Liability
Consumer litigation and product liability is the area of law that attempts to hold manufacturers, suppliers, retailers, and others who facilitate bringing products to the market liable for any injuries they cause. Liability can arise because of a party’s negligence or breach of an implied or express warranty, and can also arise under
theories of strict liability or other consumer protection laws. There are three major types of claims, which can involve:
- A defect in the design of a product
- A defect in the manufacture of a product
- A failure to warn the consumer of dangers posed by a product (this is also known as a failure to warn)
Product liability can arise from any type of consumer products, from defective baby toys to taking certain medication s that adversely affect your health. Consumer litigation is the vehicle through which an injured person can hold the party or parties responsible for their injuries liable.

Transvaginal Surgical Mesh
Recently, there has been a spate of lawsuits filed across the country alleging that manufacturers of transvaginal are liable for injuries caused by the use of their products. Transvaginal mesh is used by surgeons to treat conditions such as pelvic organ prolapse and stress urinary incontinence. The FDA has issued several public safety notifications regarding the use of transvaginal mesh and has indicated that serious complications that can arise from these procedures are “not rare.” The manufacturers that make the mesh at issue include:
- Johnson & Johnson
- C.R. Bard
- American Medical Systems
- Boston Scientific
- Mentor OB
The transvaginal mesh that these companies manufacture has been implicated in serious complications, some of which may require several surgeries to repair and in some cases may even be permanent.
Yaz Birthcontrol Lawsuits
Defective drugs can cause serious injuries, and can cause catastrophic disabilities or even be fatal. When pharmaceutical companies develop and sell drugs without fully informing the public of potential risks associated with their product they can be held liable for any injuries caused. Currently, there is active litigation pending against Bayer, the company that manufactures the birth control drugs Yaz and Beyaz. The lawsuits allege that using the drug caused blood clots, strokes, deep vein thrombosis, and pulmonary embolism and are seeking damages for the injures the drug caused. Bayer has already paid $750 million in settlements to people who have injured by their drugs, with the average settlement being around $218,000 per case.
