Makarem & Associates in class action suit against Equinox

Makarem & Associates’ attorneys Ron Makarem and Samuel Almon are representing employees in a class action suit against Equinox. 

The group of workers includes personal trainers, Pilates instructors and group fitness personnel employed by Equinox Holdings Inc. Makarem & Associates asked a California Federal Judge to grant the workers class action certification in a complaint alleging that they were underpaid and performed off-the-clock work they weren’t compensated for. According to the complaint’s allegations this included contacting Equinox members at any time during the day.

The complaints also include allegations of the fitness instructors receiving inaccurate wage statements and being denied adequate breaks between their client sessions or classes. 

The Equinox workers requesting certification ask the courts for three different classes:

    • a wage statement class of people who worked for Equinox in California from April 3, 2018 to the present;
    • people who worked for Equinox in California as a personal trainer, group fitness instructor, or Pilates instructor from April 3, 2015 to the present; and
    • people who worked for Equinox in California who received payments for missed meal breaks, and also received non-hourly pay, from April 3, 2015 to the present.
