Makarem & Associates represent woman harassed sexually by supervisor at American Golf Corporation location

The Plaintiff seeks damages for her termination after reporting sexual harassment to management, the suit alleges.

[RIVERSIDE COUNTY, PALM DESERT, CALIFORNIA, APRIL 2024]Plaintiff Yvette Lua, who is represented by Los Angeles-based employment law firm, Makarem & Associates, filed an employment lawsuit in Riverside Superior against Defendants Monterey Country Club LLC (“MCC”), American Golf Corporation (“AGC”) and their Controller, Stephan Wolkowica for sexual harassment, retaliation and wrongful termination.  

Defendant American Golf Corporation operates various golf clubs around the country, including in Southern California.  In her lawsuit, Ms. Lua claims she was employed by AGC and worked at the Monterey Country Club in Palm Desert, CA under the supervision of Stephan Wolkowicz.  

Ms. Lua alleges that AGC allowed her to work alone with Defendant Wolkowicz on the second floor of the corporate office where he was able to sexually harass her for months.  In her lawsuit, Ms. Lua alleges that Defendant Wolkowicz made inappropriate, sexually suggestive comments and advances towards her by insinuating that Plaintiff have sex with him, staring at Plaintiff’s buttocks and body and telling her he was “enjoying the view,” and instructing Plaintiff to dance for him in his office.  

In her lawsuit, Ms. Lua alleges she did not immediately report Defendant Wolkowicz’s conduct to management for fear of losing her job. Ms. Lua also alleges that after months of enduring the harassment, Defendant Wolkowicz physically touched her without her consent after he demanded that she take off her sweater and massaged her shoulders.  

Ms. Lua alleges that this incident finally brought her to report Defendant Wolkowicz’s harassment to management, but that Defendant AGC ignored her complaints, failed to conduct an adequate investigation of her complaints, and terminated her employment in retaliation for speaking out against her supervisor.  In her lawsuit Ms. Lua seeks damages for emotional distress, lost wages, attorneys’ fees, and costs.  

The case is Lua v. American Golf Corporation et al, Case No. PSC2002638, in Riverside Superior Court, Palm Springs Division.
